This Privacy Policy explains how Kraken Fitness Ltd. (“we,” “us,” or “our”) collects, uses, discloses, and protects your personal information through our website (krakentraining.com), our facility at 6637 Hastings Street, Burnaby, BC V5B 1S1, and related services.
This policy also covers the Kraken App, our mobile and web application for clients, available on the App Store, on Google Play, and in a browser. Where this policy refers to our services, it includes the app.
We are committed to protecting your privacy in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and the British Columbia Personal Information Protection Act (PIPA).
2. Information We Collect
Information you provide directly
Contact information: Name, email address, phone number, mailing address
Emergency contact information
Health and fitness information: Medical history, injuries, physical limitations, fitness goals, and other information you provide for program design
Body composition and assessment data: Measurements collected through body scanning technology during your training program
Payment information: Credit card or other payment details processed through our billing platform
Photos and progress images: If you choose to provide them
Communications: Messages between you and your trainer or our staff through our business messaging platform
Information collected automatically
Website data: IP address, browser type, device information, pages visited, and referring URLs
Cookies and tracking technologies: We use cookies and similar technologies to improve your experience and analyze website traffic
Advertising platform data: Conversion tracking data collected through Meta (Facebook) Pixel and similar tools when you interact with our ads or website
Information collected at our facility
Security camera footage: Common areas are monitored by video surveillance (no audio) for security purposes
Meeting room recordings: Meeting rooms are audio and video recorded for internal training and quality assurance purposes, with notice posted inside
Information collected through the Kraken App
Account information: Your name, email address, phone number, and profile photo if you add one
Check-in responses: The written answers you submit, and where your gym uses them, audio and video recordings of your check-ins
Progress data: Body weight, body composition, body measurements, caliper readings, resting heart rate and blood pressure, whether you enter them or a coach records them
Progress photos: If you choose to add them
Workout and activity logs: Exercises, sets, weights and repetitions, and activities you log yourself such as walking, hiking or cycling
Messages: Conversations between you and the staff at your gym through the app's messaging
Booking and session data: Sessions booked, attended and cancelled, and your session balance
Connected app data: Where you choose to connect a third-party service, the data it shares with us. This can include activity, workouts, sleep, heart rate, body measurements and nutrition. The services we support are Garmin, Fitbit, Oura, Withings, MyFitnessPal, Cronometer, FatSecret, Apple Health, Samsung Health and Health Connect. You choose whether to connect any of them, and you can disconnect at any time
Device and technical data: Device type and operating system, app version, push notification tokens, and the IP addresses used to sign in, which we use to secure your account against repeated failed sign-in attempts
3. How We Use Your Information
We use your personal information to:
Deliver your training program: Design programming, track progress, coordinate scheduling, and communicate with your coach
Process payments: Charge the payment method on file for amounts due under your agreement
Communicate with you: Respond to inquiries, send appointment reminders, training check-ins, and service-related messages via SMS, email, or phone
Send promotional messages: Inform you about new programs, services, or promotions (you can opt out at any time)
Improve our services: Analyze usage patterns, train staff, and improve our facility and programs
Ensure safety and security: Monitor facility common areas and maintain a safe training environment
Advertising and analytics: Measure the effectiveness of our advertising campaigns and understand how visitors use our website
Comply with legal obligations: Respond to lawful requests from law enforcement or regulatory bodies
How we use Kraken App information
In addition to the uses above, information in the app is used to:
Show you your own data: Your progress, workouts, check-in history and bookings
Give your coach what they need: Staff at your gym can see your check-ins, progress, photos, workouts, bookings and messages in order to coach you
Transcribe and summarise check-in recordings: Where recordings are used, they are converted to text and summarised automatically so your coach can review them. See section 6 for the providers involved
Send you notifications: Reminders and alerts by push, email, SMS or browser notification, according to the preferences you set in the app
4. SMS Communications
We use SMS text messaging to communicate with prospective and current clients. For full details on SMS message types, consent, opt-out, and frequency, see our SMS Consent Page.
Prospective clients consent to SMS when submitting information through our website, landing pages, or online forms. Current clients consent to SMS by signing a Training Agreement or Online Coaching Agreement at enrollment.
To opt out of SMS at any time, reply STOP to any message.
5. Cookies and Tracking Technologies
We use the following technologies on our website:
Essential cookies: Required for basic site functionality
Analytics cookies: Help us understand how visitors use our site (e.g., Google Analytics)
Advertising pixels: Meta (Facebook) Pixel and similar tools to measure ad effectiveness and deliver relevant advertising

6. Information Sharing and Disclosure
We do not sell, rent, or trade your personal information.
We share your information only in the following circumstances:
Service providers: We use third-party platforms to deliver our services, including platforms for workout programming, scheduling and billing, body composition analysis, video communication, and business messaging. These providers access your information only as necessary to perform their services and are bound by their own privacy obligations.
Advertising platforms: We share limited data (such as conversion events) with advertising platforms like Meta to measure and optimize our advertising.
Legal requirements: We may disclose your information when required by law, court order, or governmental regulation, or when necessary to protect our rights, safety, or property.
The Kraken App additionally shares information with:
Transcription and AI providers: Check-in audio and video recordings, and their transcripts, are processed by third-party speech-to-text and AI services in order to transcribe and summarise them for your coach. We currently use Deepgram for transcription and Anthropic for summarisation
Payment processing: Card details are entered into and held by our payment processor. We do not store your full card number
Push notification delivery: Google Firebase Cloud Messaging, in order to deliver notifications to your device
Services you connect yourself: Where you connect a wearable or nutrition app, data is exchanged with that provider under the permissions you granted, and you can revoke it at any time
7. Data Retention
We retain your personal information for as long as necessary to fulfill the purposes described in this policy, including:
Active client records: For the duration of your membership or program, plus a reasonable period after.
Financial records: As required by Canadian tax law (generally 6 years).
Security footage: Retained for a limited period and overwritten on a rolling basis.
Marketing and inquiry data: Until you opt out or request deletion.
8. Data Security
We use reasonable administrative, technical, and physical safeguards to protect your personal information. Client communications are conducted through secure business platforms. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security.
9. Your Rights
Under PIPEDA and PIPA, you have the right to:
Access your personal information held by Kraken Fitness
Correct inaccurate or incomplete information
Withdraw consent for non-essential uses of your information (such as marketing communications) at any time
Request deletion of your personal information, subject to legal and contractual obligations
File a complaint with the Office of the Privacy Commissioner of Canada or the BC Office of the Information and Privacy Commissioner if you believe your privacy rights have been violated

10. Children’s Privacy
Our website is not directed at children under 12. We do not knowingly collect personal information from children under 12. Our Teen Training program (ages 12-17) requires written consent from a parent or legal guardian, and all personal information is collected with parental knowledge and consent.

Our website may contain links to third-party websites or services. We are not responsible for the privacy practices of these external sites. We encourage you to review their privacy policies before providing any personal information.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Changes are effective immediately upon posting to the Site. The “Last Updated” date at the top of this page indicates when the policy was last revised. Your continued use of our services after changes are posted constitutes acceptance of the updated policy.
